EU Court: Vaccines Can Be Blamed for Illnesses Without Proof

The highest court of the European Union ruled Wednesday that courts can consider whether a vaccination led to someone developing an illness even when there is no scientific proof.
The decision was issued on Wednesday in relation to the case of a Frenchman known as Mr. J.W., who was immunized against hepatitis B in late 1998-99. About a year later, Mr. J.W. was diagnosed with multiple sclerosis. In 2006, he and his family sued vaccine-maker Sanofi Pasteur in an attempt to be compensated for the damage they claim he suffered due to the vaccine. Mr. J.W. died in 2011.
France's Court of Appeal ruled there was no causal link between the hepatitis B vaccine and multiple sclerosis, and dismissed the case. Numerous studies have found no relationship between the hepatitis B shot and multiple sclerosis.
After the case went to France's Court of Cassation, it was brought to the European Union. On Wednesday, the EU's top court said that despite the lack of scientific consensus on the issue, a vaccine could be considered defective if there is "specific and consistent evidence," including the time between a vaccine's administration and the occurrence of a disease, the individual's previous state of health, the lack of any family history of the disease and a significant number of reported cases of the disease occurring following vaccination.
In a statement, the court said that such factors could lead a national court to conclude that "the administering of the vaccine is the most plausible explanation" for the disease and that "the vaccine therefore does not offer the safety that one is entitled to expect." It did not rule on the specific French case.

Roman Polanski sex victim to appear in court for first time

The victim of Roman Polanski's sex assault 40 years ago is going to appeal directly to a judge to end the long-running case against the fugitive director, his lawyer said Thursday.
Samantha Geimer, 13 at the time of the crime, has long supported Polanski's efforts to end the legal saga that limits his freedom, but Friday will be the first time she's appeared in Los Angeles Superior Court on his behalf, attorney Harland Braun said.
"She's tired of this case," Braun said. "The judge is just playing games with him."
The Oscar-winner has been a fugitive since he fled to France in 1978 on the eve of sentencing for the crime of having unlawful sex with a minor. Prosecutors dropped charges that he drugged, raped and sodomized the girl.
Polanski feared the judge was going to renege on a plea agreement and send him away for more time than the six weeks he served in prison during a psychiatric evaluation prior to sentencing.
His lawyers have been fighting for years to end the case and lift an international arrest warrant that confined him to his native France, Switzerland and Poland, where he fled the Holocaust.

East Timor court drops premier's libel case against media

An East Timor court on Thursday dismissed a criminal defamation case brought by the country's prime minister against two journalists due to lack of evidence.
Rights groups and press advocates had urged that the case be dropped, fearing it would further undermine press freedom in one of the world's youngest democracies.
Accused journalist Raimundo Oki said there was "big applause" when Dili District Court judge Patrocino Antonino Goncalves issued his ruling. The trial was observed by the International Federation of Journalists, USAID and other groups.
"I am happy with the final decision because since the beginning I have always believed that the judge will do his job freely and independently," Oki said.
Oki and his former editor at the Timor Post, Lourenco Vicente Martins, would have faced up to three years in prison if found guilty of slanderous denunciation.
The defamation accusation stemmed from an error in a story published two years ago about Prime Minister Rui Aria de Araujo's involvement in a state contract for information technology services when he was an adviser to East Timor's finance minister in 2014.
The story, which said Araujo had recommended a particular company for the contract before bids opened, misidentified that company as the eventual winner of the contract.
The newspaper apologized for that error, published a front-page story on Araujo's denial and Martins resigned. But Araujo has insisted on prosecuting. East Timor's fragile press freedom has come under attack with the passing of a restrictive media law in 2014 that can be used to stifle investigative journalism.
A former colony of Portugal, it was occupied by Indonesia for a quarter century until a U.N.-sponsored independence referendum in 1999 sparked violent reprisals by the Indonesian military that killed many and destroyed its economy.

A suspect in the poisoning death of the North Korean leader's half brother wrote to her parents from jail, asking them to pray for her but saying "don't think about me too much."
Siti Aisyah, an Indonesian mother who worked in Malaysia, appeared in court Tuesday along with a second suspect, Doan Thi Huong of Vietnam. Their trial was formally transferred to the High Court as the lower court had no jurisdiction to hear a murder case.
They are the only people who have been arrested in the assassination of Kim Jong Nam at the Kuala Lumpur airport on Feb. 13.

The suspects are accused of smearing VX nerve agent on Kim's face in the crowded airport terminal; he died soon afterward. The women have said they were duped into thinking they were playing a harmless prank for a hidden-camera show.
Yusron Ambary, counsellor at the Indonesian Embassy, said Siti wrote a letter to her parents recently, asking them not to worry about her.
"I am in good health. Just pray. Don't think about me too much. Keep healthy and pray at night. I have a lot of people helping me. The embassy officials always come to see me, my lawyers also. Don't worry. Pray for me so that the case will be over soon and I can go back home. Send my love to my son Rio," he read from the letter to reporters outside the courtroom.
Armed escorts accompanied the women, who smiled at their embassy representatives as they were brought to the dock.
Prosecutor Iskandar Ahmad said the date for their first appearance in the High Court would usually be within a month. The suspects would then enter pleas and the trial would have to start within 90 days, Iskandar said.

Indiana high court to take up police unreasonable force case

The Indiana Supreme Court is to take up the case of a man who claims Evansville police were too forceful when they used a SWAT team and flash-bang grenades to serve a search warrant.
The Evansville Courier and Press reports the court is to consider 31-year-old Mario Deon Watkins' case, which rises from his felony drug conviction. He claims the Evansville Police Department used unreasonable force when a SWAT team and flash-bang grenades were used to serve a search warrant.
The Indiana Court of Appeals in January reversed Watkins' sentence, criticizing use of the grenades that went off in the same room as a 9-month-old baby. But Indiana Attorney General Curtis Hill is asking the state's Supreme Court to clarify whether the state constitution prohibits police from using a SWAT team or the grenades. |
