US appeals court upholds Maryland assault weapons ban

Maryland's ban on 45 kinds of assault weapons and its 10-round limit on gun magazines were upheld Tuesday by a federal appeals court in a decision that met with a strongly worded dissent.
In a 10-4 ruling, the 4th U.S. Circuit Court of Appeals in Richmond, Va., said the guns banned under Maryland's law aren't protected by the Second Amendment.
"Put simply, we have no power to extend Second Amendment protections to weapons of war," Judge Robert King wrote for the court, adding that the Supreme Court's decision in District of Columbia v. Heller explicitly excluded such coverage.
Maryland Attorney General Brian Frosh, who led the push for the law in 2013 as a state senator, said it's "unthinkable that these weapons of war, weapons that caused the carnage in Newtown and in other communities across the country, would be protected by the Second Amendment."
"It's a very strong opinion, and it has national significance, both because it's en-banc and for the strength of its decision," Frosh said, noting that all of the court's judges participated.
Judge William Traxler issued a dissent. By concluding the Second Amendment doesn't even apply, Traxler wrote, the majority "has gone to greater lengths than any other court to eviscerate the constitutionally guaranteed right to keep and bear arms." He also wrote that the court did not apply a strict enough review on the constitutionality of the law. |

German court excludes Jewish brothers from Auschwitz trial

A German court has excluded two elderly Jewish American men from joining the trial of a 96-year-old former Auschwitz SS medic, because their mother was not killed in the death camp's gas chambers during the time covered in the indictment.
Hubert Zafke is charged with 3,681 counts of accessory to murder for a one-month period in 1944.
The Neubrandenburg state court said Tuesday it was excluding Walter and William Plywaski, of Boulder, Colorado, from joining the trial as co-plaintiffs, as allowed under German law for victims' relatives.
Their attorneys argue that Zafke was present for a longer period than covered by the indictment, and say they'll appeal.
The trial has been repeatedly delayed over the defendant's health and complaints from the co-plaintiffs the judges are biased. |

Indiana Supreme Court reprimands Floyd County prosecutor

The Indiana Supreme Court has publicly reprimanded Floyd County Prosecutor Keith Henderson for a conflict of interest in a triple-murder case but declined to suspend him as its disciplinary commission suggested.
The court ruled Friday that Henderson violated rules of professional conduct by simultaneously representing the state in the prosecution of David Camm and pursuing a book deal in the case in which the former Indiana state trooper was accused of killing his wife, Kimberly, and their two children in the fall of 2000. After his first two convictions were reversed on appeal, Camm was acquitted in a third trial in fall 2013.
"The violation is serious and adversely affected the administration of justice in this case," the court wrote. "However, noting (Henderson's) misconduct occurred in connection with a single, unusual case and is an aberration from what otherwise has been a long and distinguished career as a public servant, we conclude a suspension is not warranted in this case."
The Indiana Supreme Court Disciplinary Commission formally asked for Henderson to be suspended in October.
After Camm's defense team learned of Henderson's plans to write a book, they asked that he be removed from the case, court records show. The request was denied initially but later granted on appeal by the Supreme Court.
The disciplinary commission, which investigates claims of misconduct against licensed attorneys including prosecutors, filed a complaint against Henderson in March 2016 alleging he violated rules of conduct when he signed an agreement with a literary agency to produce a book about the Camm trials.

Kansas Supreme Court to hear death row inmate's appeal

Attorneys for a Kansas death row inmate convicted of killing his estranged wife, their two daughters and his wife's grandmother in 2009 will get to make their case to the state's highest court about why he should be spared.
James Kraig Kahler argues in his appeal that the court where he stood trial made mistakes, and he questions whether his death sentence was warranted.
Friday's hearing will be the Kansas Supreme Court's first death penalty case since Election Day, when voters retained four of its justices who were targeted for ouster partly because the court overturned other death sentences.
Kansas reinstated capital punishment in 1994 but hasn't executed anyone in more than half a century. The state Supreme Court has overturned death sentences seven times in 20 years, with five of those decisions later reversed by the U.S. Supreme Court.
Kahler was convicted in 2011 of fatally shooting Karen Kahler, 44, her 89-year-old grandmother, Dorothy Wight, and the Kahlers' two daughters, 18-year-old Emily and 16-year-old Lauren, at Wight's home in Burlingame, about 65 miles southwest of Kansas City. Authorities said he went from room to room shooting his victims. The couple's 10-year-old son survived unharmed.

The leader of one of New Jersey's largest mosques has taken the stand to defend himself against charges that he lied on his green card application.
Imam Mohammad Qatanani is the leader of the Islamic Center of Passaic County.
A judge ruled against immigration authorities' attempt to have him deported eight years ago. Federal officials say he didn't disclose that he'd been convicted in Israel for being a member of Hamas.
Qatanani began testifying Tuesday before an immigration court judge in Newark as part of the appeals process.
Qatanani denies he was ever part of the group classified as a terrorist organization by the U.S. government. He says he was only detained and never convicted.
Qatanani came to the U.S. from Jordan. He was born in the West Bank.
