The Rosen Law Firm, P.A. today announced that a class action lawsuit has been filed on behalf of investors who purchased the common stock of GMX Resources, Inc. (NYSE: GMXR) pursuant or traceable to the company’s stock offerings on July 17, 2008, May 13, 2009 and October 22, 2009. The lawsuit seeks to recover investors’ damages from violations of the federal securities laws.

The Complaint alleges that GMX Resources violated the securities laws by issuing false financial statements to investors in the stock offerings on July 17, 2008, May 13, 2009 and October 22, 2009. On March 11, 2010, the company disclosed that its full year 2008 and quarterly 2009 financial statements were inaccurate and must be restated. The company also warned that investors could no longer rely on its financial statements. GMX subsequently restated its financial statements to correct for the method used to record full cost pool impairment charges and related deferred income taxes. As a result of the restatement, the company’s net loss for fiscal year 2008 was $124.6 million as compared to the originally reported $81.7 million.
GMX Resources share price has declined substantially since the stock offerings and investors in the stock offerings have suffered significant damages.

Insurer settles suit with former USU frat members

A Georgia insurance company that paid a wrongful death claim on behalf of a former Utah State University fraternity has settled the lawsuit it brought against four of the fraternity's members.
The Herald Journal of Logan reports that attorneys for RSUI Inc. told a 1st District Court judge the company had resolved a dispute with the four men. Court records show attorneys met with the judge April 20 — one day before a planned hearing.
RSUI sought $50,000 each from Sigma Nu pledge Chad Burton and chapter officers Cody Littlewood, Colton Hansen and Mitchell Alm as compensation for a settlement payment to the parents of Michael Starks.
Starks died Nov. 21, 2008, from alcohol poisoning after a fraternity event.
At the time, RSUI was the insurer for the fraternity and its members, including pledges. RSUI attorneys have acknowledged that both the company and the four defendants would have been jointly liable to Starks' parents, George and Jane Starks of Salt Lake City. The company claims it paid the full amount of a settlement with the Starks, although those terms have not been made public. |

Smartphones put the mobile web at your fingertips and are capable of many functions through their complex programming. Internet browsing, downloading and email are now available to people on the go at speeds that are becoming increasingly comparable to home computers. Certain limitations and restrictions exist naturally because of the physicality of mobile devices themselves. This has meant that mobile web developers have had to program sites strategically to fit and function well on smartphones of all platforms. Because the mobile internet needs to fit onto the small screen of a smartphone, browsers and operating systems are vastly different from that of a computer. Choices of browsers are limited on smartphones but because there are a range of smartphones in the first place, the mobile web must be a dynamic technology that is highly adaptive. Speed is a significant issue when accessing WiFi on a smartphone because of the limitations of the technology. Depending on the quality of the phone as well as the level of available service based on your location and carrier, a smartphone can have significantly slower internet access speed than a computer. Mobile broadband is made possible in the same way that cell phones are: they use radio waves and frequencies. Radio towers send little packets of data (like emails, website pages, music and streaming video) back and forth to each other making them accessible to you on your smartphone. The reason for the need for mobile web development is that the device on which you access the mobile web is vastly different than it was traditionally on a regular computer. The physical and technological limitations of the smartphone make for unique challenges to developing websites that work seamlessly with all the different types of smartphone platforms that are out there and that continue to emerge every day.
