Court rules in favor of fired transgender funeral director

A woman was illegally fired by a Detroit-area funeral home after disclosing that she was transitioning from male to female and dressed as a woman, a federal appeals court ruled Wednesday.

The 6th U.S. Circuit Court of Appeals said R.G. & G.R. Harris Funeral Home in Garden City discriminated against director Aimee Stephens by firing her in 2013.

In a 3-0 decision, the court said "discrimination against employees, either because of their failure to conform to sex stereotypes or their transgender and transitioning status, is illegal under Title VII" of federal civil rights law.

The court overturned a decision by U.S. District Judge Sean Cox, who said the funeral home had met its burden to show that keeping Stephens "would impose a substantial burden on its ability to conduct business in accordance with its sincerely held religious beliefs."

The lawsuit was filed by the U.S. Equal Employment Opportunity Commission.

"The unrefuted facts show that the funeral home fired Stephens because she refused to abide by her employer's stereotypical conception of her sex," said judges Karen Nelson Moore, Helene White and Bernice Donald.

The EEOC learned that the funeral home, until fall 2014, provided clothing to male workers dealing with the public but not females. The court said it was reasonable for the EEOC to investigate and discover the "seemingly discriminatory clothing-allowance policy."

Stephens said in a statement released by the American Civil Liberties Union that nobody "should be fired from their job just for being who they are," adding "I'm thrilled with the court's decision."

Ohio high court will review full autopsies from 8 slayings

The Ohio Supreme Court wants to see unredacted autopsy reports from eight slayings in one family as justices consider media lawsuits seeking access to those full reports from the year-old, unsolved case.

The court on Wednesday ordered the Pike County coroner in southern Ohio to submit the reports within two weeks for justices to review outside of public view.

The case involves seven adults and a teenage boy from the Rhoden family who were found shot to death at four homes near Piketon last April.

The Columbus Dispatch and The Cincinnati Enquirer separately sued for access to the full autopsies.

Authorities want to shield information, arguing that its release could compromise the investigation. The coroner also says victims' relatives raised concerns about sharing details of how their loved ones died.


Former Haitian rebel leader due in US court on drug charges

A former Haitian rebel leader who was recently elected senator in Haiti has been brought to the U.S. to face longstanding federal drug trafficking charges.

Court records show that Guy Philippe is to make his initial appearance Friday afternoon in Miami federal court. Philippe was flown to the U.S. following his arrest Thursday in the Haitian capital while he appeared on a live radio show.

Philippe faces several drug trafficking charges including conspiracy to import cocaine into the U.S. He has long maintained his innocence and blamed the accusations on political enemies.

Philippe was recently elected to the Haitian Senate. A former police chief, Philippe was a key part of a 2004 uprising that ousted then-President Jean-Bertrand Aristide. It wasn't immediately clear if Philippe is represented by a U.S. lawyer.



Landowners to court: Exxon Mobil pipeline breaches contract

Attorneys for landowners along a crude oil pipeline that ruptured in Arkansas in 2013 say Exxon Mobil Pipeline Co. breached its contract because the pipeline interferes with their ability to enjoy their property.

Attorneys for the landowners and Exxon Mobil appeared Wednesday before judges from the 8th U.S. Circuit Court of Appeals in Minnesota.

The landowners asked the appeals court to reinstate their case, which was dismissed last year, and have it re-certified as a class-action suit. Attorney Phillip Duncan says it's an issue of honoring easements.

Exxon Mobil attorney Gary Marts said the case was properly dismissed. He says landowners are essentially trying to regulate pipeline safety through a lawsuit - but that's the job of a federal agency.

The Pegasus Pipeline runs through Arkansas, Missouri, Illinois and Texas.
