Court halts Texas execution of ex-Army recruiter

A former Army recruiter who for the third time this year was hours away from his scheduled execution for the rape-slaying of a woman in Fort Worth nearly 10 years ago was granted yet another reprieve by the U.S. Supreme Court on Tuesday.
Cleve Foster, 47, was set to die Tuesday evening in Huntsville.
The high court twice earlier this year stopped Foster's scheduled lethal injection. The latest court ruling came about 2½ hours before Foster could have been taken to the Texas death chamber.
Foster was meeting with one of his lawyers in a small holding cell a few feet from the death chamber when a Texas Department of Criminal Justice spokesman delivered the news.
"He thanked God and pointed to his attorney, saying this woman helped save his life," prison spokesman Jason Clark said.
He also said Foster repeated his insistence that he was innocent. |

Iowa hiring lawsuit begins Monday

Trial in a class-action lawsuit alleging racial discrimination against blacks is set to begin in a Polk County District courtroom.
Earlier this month, a judge rejected the state's request to throw out the lawsuit against the state.
Judge Robert Blink disagreed with the state's argument that the case was too broad be legally viable. He said the state agreed years ago to certify the case for class action.
The trial is expected to last three weeks.
The lawsuit was filed in 2007 by 14 people who claim they were denied state positions because they are black. It's grown to cover an estimated 6,000 blacks who sought employment or promotions with the state since 2003. |

Court: Samsung can't sell tablet in Germany

A German court rules that Samsung Electronics's Galaxy Tab cannot be sold in Germany because it violated patents of rival Apple's iPad2.
A Duesseldorf state court said Friday it would not allow Samsung, based in Seoul, South Korea, to market its Galaxy Tab 10.1 in Germany because it too closely resembles the iPad2.
Already in August, the court had ruled in favor of Apple, based in Cupertino, California, forcing Samsung to withdraw its tablet from the market.
Samsung challenged the ban. The companies are involved in a series of legal disputes in countries around the world over allegations that each copies the other's technology. |

Wal-Mart Uses Class Action Against Netflix

Wal-Mart is using its failed class action lawsuit with Netflix to attract new users to its video streaming service, Vudu.
A federal court in California agreed late last week to allow Wal-Mart to pay $27.5 million to 40 million Netflix subscribers. The kicker? They can make the payment in the form of gift cards for Walmart.com. As a result, this also gives Wal-Mart access to Netflix's customer database.
The class action suit came in response to a dinner meeting in 2005, where the CEOs of Netflix and Wal-Mart allegedly agreed to share the DVD market. According to consumer advocates, under the pact, Wal-Mart agreed not to rent DVDs if Netflix promised not to sell them. Class action suits were filed against both companies in 2009, claiming that this agreement violated antitrust laws.
While Wal-Mart decided to settle the case, Netflix is still fighting the allegations, claiming the suit "has no merit."
Wal-Mart's settlement, which still has to be finalized in February 2012, comes as the discount giant is in the process of aggressively promoting its Vudu service, which it acquired in February 2010. At the same time, Netflix is in dire need of an image cleanup, following several unfriendly consumer moves, including a recent price hike and the falling out of its Liberty Starz deal. |

Court convicts Serb general for Balkan atrocities

The Yugoslav war crimes tribunal sentenced the former chief of the Yugoslav army to 27 years imprisonment Tuesday for providing crucial military aid to Bosnian Serb forces responsible for the Srebrenica massacre and for a deadly four-year campaign of shelling and sniping in Sarajevo.
The case against Gen. Momcilo Perisic was the first time the U.N. court convicted a civilian or military officer from Yugoslavia of war crimes in Bosnia, and underscored the Yugoslav army's far-reaching support for Serb rebels in both Bosnia and Croatia who committed the worst atrocities of the Balkan conflicts in the early 1990s.
The link between the disintegrating Yugoslav federation and Serb forces in the breakaway republics has been a matter of dispute and was the keystone of the trial in The Hague of Yugoslav President Slobodan Milosevic. But that trial ended without a conclusion when Milosevic died in his cell in 2006 of a heart attack.
The former Yugoslavia is now divided up into independent states that include Serbia, Bosnia and Croatia. |
